Terms & policies.

BrandMyBags values creativity and respects intellectual-property rights. Customers submitting designs for custom printing retain full ownership of their work. We do not claim ownership of customer artwork unless granted separately in writing.

When you submit a design for printing, you affirm that you've obtained all necessary permissions, licenses, and authorizations for any copyrighted materials or trademarks included. You are responsible for ensuring designs don't infringe third-party rights.

We reserve the right to refuse to print designs that appear to violate intellectual property and may request verification of ownership or authorization. If we discover infringing content already on press, we reserve the right to remove, cease, or refuse to print such content.

If you believe your IP has been infringed by something printed on our press, contact info@brandmybags.com with supporting documentation and we'll investigate.

Written quotations remain valid for thirty (30) days from issue unless otherwise noted. Quotations are not firm offers and are subject to change. Once an order is accepted, it cannot be cancelled or modified without our written consent.

Published prices are subject to change without notice and exclude freight, taxes, and governmental fees unless expressly stated. Buyers pay all applicable taxes except the Seller's income tax.

Unless otherwise agreed, payment is due NET 30 days from invoice. Unpaid amounts accrue interest at 1.5% per month or the maximum legal rate, whichever is less. Buyers also cover collection costs, including reasonable attorney fees.

The Seller's warranty is limited to the manufacturer's transferable warranty. BrandMyBags disclaims all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, and excludes liability for consequential or special damages.

Buyers are responsible for confirming that goods meet their specifications before mass production.

Delivery dates are approximations. We use commercially reasonable efforts to meet them but have no liability for delays caused by strikes, natural disasters, government action, supplier delays, or other causes beyond our reasonable control.

Title and risk of loss transfer to the Buyer F.O.B. at the Seller's facility (or supplier's facility, when applicable).

Buyers have three (3) days from receipt to report defects in writing. Shipping-damage claims require notification within seven (7) days to the freight carrier. After these periods, goods are deemed accepted.

Accepted goods may be returned within ninety (90) days if non-defective, with a 20% restocking fee and transportation costs paid by the Buyer. Returns require a Return Material Authorization (RMA) — request one by emailing info@brandmybags.com.

If the Buyer cancels or defaults without cure within thirty (30) days of notice, the Buyer is responsible for all direct and indirect costs incurred, including restocking charges, manufacturer reimbursements, and a negotiated profit on the cancelled work.

Buyers are responsible for legal compliance regarding safety and product use, and shall indemnify the Seller against any claims related to a Buyer's use of the goods.

Some goods may require export authorization. No delivery occurs until authorization is obtained.

This agreement is governed by the laws of the State of Michigan. Exclusive jurisdiction lies with the courts of Oakland County, Michigan. Any action against the Seller must be filed within six (6) months of delivery.

This agreement can be modified only by written signature from both parties. A Buyer's purchase orders constitute acceptance of these terms, even if they contain different or additional provisions.
